Welcome to Droplet®. These Terms of Service govern your purchases and use of our website. Droplet® is a product line of Spearmark Health Ltd. By placing an order, you agree to these terms.

1. Orders and Eligibility

  • UK Only: We only accept orders from and deliver to addresses within the United Kingdom (Zones A–D). We do not ship internationally.

  • Online Purchases: We only accept orders placed directly through our e-commerce website. We do not accept orders by phone, email, or written mail.

  • Order Acceptance: A contract is formed between us only when we dispatch your products.

  • Right of Refusal: We reserve the right to reject or cancel any order (or part of an order) at our discretion. Common reasons include:

    • Products are out of stock.

    • We cannot obtain payment authorisation.

    • The website displayed a pricing or product description error.

    • You do not meet our eligibility criteria.

    • We suspect you intend to resell our products. Commercial resale is strictly prohibited.

2. Delivery, Risk, and Returns

  • Policies: All shipments and returns are handled in accordance with our full Delivery and Returns Policies.

  • Ownership and Risk: Responsibility and legal ownership of the products pass to you immediately upon delivery to your address or to anyone accepting the delivery on your behalf.

3. Medical Disclaimer (Important)

  • Not a Medical Device: Droplet® is not a medical device. The website, its content, and any generated reports do not constitute and should not be interpreted as medical advice, diagnosis, or treatment.

  • No Substitute for Professional Care: Our products and digital content are not a substitute for consultations with qualified healthcare professionals who understand your specific medical needs.

  • Spearmark Health Status: Spearmark Health Ltd is not a medical organization. Our staff cannot and will not provide medical advice or diagnoses. 4. Warranties and Faulty Goods

Subject to the Consumer Rights Act 2015, we warrant that your products will arrive:

  • As described on our website.

  • Fit for their intended purpose.

  • Of satisfactory quality for a period of 12 months from the delivery date.

Warranty Exclusions: We are not liable for product faults or damage if:

  • You continue to use the product after notifying us of a defect.

  • The issue arises because you altered, repaired, or failed to follow our written or verbal instructions regarding storage, installation, cleaning, or everyday use.

5. Cancellations and Returns (Right to Change Your Mind)

  • 14-Day Window: You have a legal right to cancel your order at any time within 14 days of receiving your products. You may also cancel an order before dispatch by emailing us at customerservices@droplet-hydration.com.

  • Return Conditions: You must return the products to us at your own expense within 14 days of your cancellation notice. Products must be unused, undamaged, and in their original resalable condition.

  • Duty of Care: You have a legal obligation to take reasonable care of the products while they are in your possession. We reserve the right to deduct compensation from your refund if the items are returned damaged or degraded.

  • Refunds: Once we receive and verify the return, you will receive a full refund of the price paid for the order.

6. Limitation of Liability

  • General Exclusion: Spearmark Health Ltd, its directors, employees, and agents exclude all liability for any loss or damage that results from your use, or inability to use, this website or its materials. This includes, without limitation, direct, indirect, punitive, or consequential damages, loss of income, profits, goodwill, data, or business interruptions, whether caused by contract breach, negligence, or web viruses.

  • Delivery Issues: We exclude all liability for any financial or personal loss resulting from late, delayed, or misrouted deliveries.

  • Technical Maintenance: If your use of our website requires you to service, repair, or correct your own equipment, software, or data, you assume all associated costs.

  • What We Do Not Exclude: Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, fraud, fundamental misrepresentation, or any other liability that cannot be legally excluded under English law.

  • Indemnity: You agree to fully indemnify and hold Spearmark Health Ltd and its staff harmless from any claims, liabilities, damages, losses, or legal fees arising from your breach of these terms or misuse of this website.

7. Force Majeure (Events Beyond Our Control)

We are not liable for any failure or delay in performing our obligations due to events outside our reasonable control. This includes natural disasters (fire, flood, storm), war, strikes, government sanctions, lockouts, or widespread failures of electricity, internet, or telecommunication networks.

8. Governing Law and Legal Disputes

  • Jurisdiction: These terms are governed by and construed in accordance with English law. Any legal disputes arising from these terms or your use of the website will be subject to the exclusive jurisdiction of the courts of England.

  • International Use: We do not warrant that our products are appropriate or legal for use outside the United Kingdom. If you choose to access this website from outside the UK, you do so at your own risk and are entirely responsible for complying with your local laws.

9. Miscellaneous

  • Transfer of Rights: You may not assign, sublicense, or transfer any of your rights under these terms to another person.

  • Severability: If a court finds any part of these terms invalid or unenforceable, that specific provision will be removed, and the remaining terms will continue to have full legal force and effect.

  • Third-Party Rights: Under the Contracts (Rights of Third Parties) Act 1999, only you and Spearmark Health Ltd have the right to enforce these terms.
